This project undertakes a doctrinal, empirical, and interdisciplinary study of the specific features of pre-trial investigations in criminal proceedings concerning conflict-related disappearances and the discovery of unidentified bodies and human remains in Ukraine. It examines the legal status of persons missing under special circumstances, the criminal-law and forensic characteristics of the relevant offences, and the mechanisms used to locate missing persons and identify the deceased. Drawing on Ukrainian legislation and practice, international humanitarian law, international human rights standards, and relevant guidance, the study explores the criminal-procedural and humanitarian dimensions of such investigations, including their role in pursuing the objectives of criminal proceedings, clarifying the fate of missing persons, identifying the deceased, and protecting the rights and legitimate interests of their family members. The project aims to identify procedural and institutional problems and develop recommendations for improving pre-trial investigations, inter-agency cooperation, and the protection of families’ rights. It seeks to advance academic research, enhance investigative effectiveness, and improve practices for locating missing persons and identifying the deceased in accordance with international standards.
